OFFICIAL CONTEST RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN A PRIZE

MediaCo Holding Inc. d/b/a WBLS-FM (“MediaCo” or WBLS) is givingWBLS listeners a chance to win a Disney Cruise Line vacation for (4) four aboard the Disney Destiny in the WBLS “DISNEY CRUISE DESTINY” TRIP GIVEAWAY Contest(the “Contest”). This Contest is governed by these Official Contest Rules (the “Rules”), as well as by MediaCo’s Official General Contest Rules (“General Rules”). In the event there is a discrepancy or inconsistency between these Rules and the General Rules, these Rules shall govern. Any individual who enters, attempts to enter or in any way participates or attempts to participate in the Contest (“Participant”) agrees to be bound by the terms and conditions provided in these Rules and to the extent applicable the General Rules, as well as by all interpretations of these Rules by MediaCo and by all other decisions of MediaCo which are final and binding in all matters relating to the Contest.

NO PURCHASE NECESSARY:

No purchase is necessary to enter or win a prize. A purchase will not improve your chances of winning.

APPLICABLE LAW (VOID WHERE PROHIBITED):

All Contests are subject to and governed by applicable federal, state, and local laws and regulations. Participation in this Contest is void where prohibited or otherwise restricted by law.

CONTEST SPONSOR:

The sponsor of this Contest is MediaCo (the “Sponsor”).

CONTEST CANCELLATION, SUSPENSION OR MODIFICATION:

Sponsor reserves the right to cancel, terminate, modify, or suspend the Contest if it is not capable of being completed as planned for any reason, including, but not limited to, infection by computer virus or “bugs”, tampering, unauthorized intervention, fraud, or technical failures of any kind or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest. The decision of any Sponsor to cancel, terminate, modify or suspend the Contest shall be final in all respects.

ELIGIBILITY:

Geographical, Age and Parental Consent Requirements: The Contest is open to the legal United States residents of the states of New York, New Jersey and Connecticut who are at least twenty-one (21)years of age or older at time of entry. Sponsor reserves the right to refuse to award a prize to, or on behalf of, a minor.

Contest Entity and Immediate Family Member Ineligibility: The officers, directors, employees, contractors, and agents of MediaCo, its parent companies, and any entity involved in the sponsorship, development, production, implementation and distribution of the Contest as well as their respective parents, affiliates, divisions, subsidiaries and successor companies (collectively the “Contest Entity”), and their immediate family members (and those living in the same household, whether or not related), are prohibited from participating in the Contest and do not qualify as Participants. “Immediate family members” shall include spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws”, or by current or past marriage, remarriage, adoption, co-habitation or other familial extension.

Past Prize Winners: Participants who have won a WBLS contest in the last fourteen (14) days or who have won prizes valued over Five Thousand Dollars ($5,000.00) in the last twelve (12) months are ineligible.

Eligibility Frequency Limits: The Sponsor may set limitations on how frequently an individual can be eligible to win more than one prize within a specified time period. For ticketed prizes (e.g., concerts, theatrical plays, etc.) and/or vacation packages, an individual may not win more than once (1) for a specific event. For cash contests, an individual may win only once (1) every fourteen (14) days. For local sweepstakes/contests, an individual may win only once (1) every seven (7) days. An individual may not win more than three (3) times in one month. Only one (1) winner per household is permitted in any contest or sweepstakes. “Household members” shall mean people who share the same residence at least three (3) months a year.

Employer Restrictions: Participant is solely responsible for reviewing and understanding Participant’s employer’s policies regarding Participant’s eligibility to participate in contests. Participant may be disqualified from entering into this Contest or receiving prizes if Participant is participating in this Contest in violation of their employer’s policies.

HOW TO ENTER:

The Submission period begins Wednesday, November 19, 2025, at 10:00AM ET and ends on Sunday, December 7, 2025, at 11:59PM ET (the “Entry Period”). Eligible Participants can enter the Contest in the following way:

the on-line Contest submission instructions. Participants may enter the Contest online one (1) time only.

Entries Are the Sole and Exclusive Property of Sponsor: All Contest entries and/or related submissions become the sole and exclusive property of the Sponsor upon transmission. Contest entries will not be returned and may be used by any Contest Entity for any purpose whatsoever related to the Contest, without additional compensation to the participant or any other individual or entity.

False Fraudulent or Deceptive Entries or Acts: Participants who, in the view of Sponsor, provide false, fraudulent or deceptive entries or who engage in false, fraudulent or deceptive acts in connection with the Contest will be disqualified and subject to criminal prosecution.

PARTICIPATION PROBLEM DISCLAIMER:

Even if alleged to be caused by the sole or partial negligence of the Sponsor, the Sponsor is not responsible for any problems which affect or result from participation or attempted participation in the Contest. This includes, but is not limited to, the following problems:

Incorrect, incomplete or inaccurate entry information;
Human errors;
Failures, omissions, interruptions, deletions or defects of any wireless network, telephone network, internet service, computer systems, servers, utility providers, or software;
Inability to send a text-message;
Identity theft;
Tampering, destruction or unauthorized access to, or alteration of, entries or computer data;
Network hackers or other unauthorized access to Sponsor’s computer network;
Data that is processed late or incorrectly or is incomplete or lost due to wireless network, telephone network, computer or electronic malfunction or traffic congestion on wireless or telephone networks;
Printing errors;
Equipment malfunctions; and
Late, misdirected, lost, misplaced, illegible, mutilated or postage-due entries.

PRIZES:

There will be a total of one (1) Grand Prize valued at Twelve-Thousand, three-hundred, fifty-four dollars and sixteen cents ($12,354.16) awarded in this Contest.

Disney Destinations, LLC, (“Disney”) shall provide to the winner the following vacation package (“Vacation Package”):

One (1) Four or Five (4 or 5)-night Disney Cruise Line vacation for winner and up to three (3) persons, to be taken aboard the Disney Destiny. The Vacation Package is subject to the conditions set forth below.

If winner resides outside a 250-mile radius of the Port Everglades:
Up to Four (4) roundtrip coach airfares (with possible layovers) between the major U.S. gateway airport closest to the winner’s residence (“Departure Airport”) and Fort Lauderdale Airport in Fort Lauderdale, Florida. (“Arrival Airport”);
One (1) standard room with a maximum occupancy of Four (4) persons at a Fort Lauderdale Hotel (hotel selection at the discretion of Disney) for one (1) night prior to the ship’s departure;
Ground transportation for up to Four (4) persons or voucher(s) for local transportation from the Arrival Airport to the hotel, from the hotel to Port Everglades, and from Port Everglades to the Arrival Airport (at the discretion of Disney);

One (1) Four or Five (4 or 5) night cruise on the Disney Destiny for up to Four (4) persons, consisting of:
One (1) stateroom aboard the Disney Destiny (location/category at the discretion of Disney) with a maximum occupancy Four (4) people;
All meals onboard the Disney Destiny (excluding specialty and fine dining);

All costs and expenses not expressly stated in the Vacation Package description above are excluded and solely the responsibility of winner or guests, including but not limited to:

Shore excursions
Travel insurance
Laundry service
Spa treatments
Alcoholic and specialty non-alcoholic beverages (including specialty coffee)
Individually charged snacks and treats (including but not limited to movie popcorn,

packaged candy, ice cream, gelato, pastries, and bar snacks)

Local and long distance telephone calls
Ship to shore communications including internet
Merchandise and souvenirs
Tips and gratuities not specifically set forth above

The approximate retail value (“ARV”) of the Vacation Package is $12,354.16, which includes Taxes, Fees, and Port Expenses (as defined on the Disney Cruise Line website). The actual value of the Vacation Package may vary depending on point of departure and fluctuations of rates and airfares (if applicable). If the actual value of the Vacation Package is less than stated ARV, the difference will not be awarded.

Please Note Restriction for the Vacation Package:

Travel for the Vacation Package must be booked at least forty-five (45) days prior to the intended travel dates and must occur from 12/30/2025 to 11/20/2026. If travel is not completed by 11/20/2026 the prize will be forfeited without compensation of any kind. No changes will be made to travel details once any element(s) of the travel arrangements have been booked except in Disney’s sole discretion. Block-out dates may apply. Vacation dates and accommodations are subject to availability; certain restrictions and block-out dates may apply. Disney reserves the right to change the allowable travel dates, cruise ship or any other component of the Vacation Package, for any reason and in its sole discretion. No substitution of Vacation Package or any elements thereof is allowed, except at Disney’s sole discretion. Vacation Package components may not be sold, traded, transferred, or refunded. Vacation Package is not redeemable for cash. Vacation Package is non-commissionable.
Vacation is for the winner and up to three (3) guest(s) of the winner’s choosing. Once selected by the winner, guests cannot be changed without the express consent of Disney, which may be withheld for any reason. If the winner chooses to bring less than the allotted number of guests, the Vacation Package will be awarded in increments suitable for the actual number of participants with no substitute Vacation Package or compensation provided to the winner.
If Vacation Package includes airfare, the winner and guests must travel together on the same itinerary, and air transportation must be round-trip from/to the Departure Airport (with possible layovers). Disney will determine airline and flight itinerary in its sole discretion. Airline carrier’s regulations and conditions apply to air travel. Airline tickets are nonrefundable, non-transferable, and are not valid for upgrades.
Actual value of the prize awarded depends on a number of factors, including booking and travel dates and the number of travelers, and therefore may be lower or higher than the estimated value at the time it is fulfilled. If the actual value of the prize is less than the stated estimated value, the difference will not be awarded. The winner will not receive compensation for any element(s) of the Vacation Package that any participant(s) is unable to use for any reason, and such unused portion(s) of the Vacation Package will be forfeited.
No refund or compensation will be made in the event of the cancellation or delay of any flight or cruise (as applicable). Disney is not liable, including for any costs or expenses, if any component of the Vacation Package is delayed, postponed or cancelled for any reason and winner will not be reimbursed, and no substitution will be provided except as in Disney’s sole discretion.
If Vacation Package includes hotel stay, photo identification and credit card in good standing or cash deposit may be required at check-in for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the prize).
The winner and each guest will be required to execute a liability/publicity release and waiver form prior to booking of any travel. The winner and each guest will also be required to sign the Disney Cruise Line cruise contract before embarkation (the “Cruise Contract”). The Cruise Contract is available at www.disneycruise.com/cruisecontract. Failure to return the executed release form or to accept and sign the Cruise Contract within the specified time periods will result in forfeiture of the Vacation Package. winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of their travel party, related to any use or misuse of the Vacation Package or any related activity or travel.
Health and safety measures and operational guidelines, ports of call and offerings may change at any time without notice. Certain onboard venues, experiences and other offerings may be modified or unavailable, will have limited capacity and will be subject to limited availability, advance reservations or even closure.
In the event the winner and/or guest(s) engage in behavior that, as determined by Disney in its sole discretion, is obnoxious or threatening, illegal, is intended to annoy, abuse, threaten or harass any other person, or is contrary to Disney’s health and safety protocols, rules or policies in effect at the time of the Vacation Package, Disney reserves the right to terminate the Vacation Package or other applicable experience early, in whole or in part, and send the winner and/or guest(s) home with no further compensation. The winner acknowledges and agrees to be solely responsible for any actions, claims or liabilities of any member of the group.
Disney, its parent, related, affiliated, and subsidiary companies and their respective officers, directors agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the prize, the receipt, use and/or enjoyment of the prize and/or the promotion.
Minors under the age of eighteen (18) not traveling with a parent or legal guardian must be accompanied by an adult over the age of twenty-one (21) in the same stateroom. The parent or guardian of any minor not traveling with a parent or guardian must appoint an adult to have custody and control over their minor and to contract on their behalf in connection with the Vacation Package. An appointment form will be included in the document package and must be signed by parent or legal guardian prior to embarkation at the Disney Cruise Line terminal.
Vacation Package is awarded “as is” with no warranty or guarantee, expressed or implied, being provided by Disney.
Vacation Package fulfillment is subject to restrictions. Failure to accept the Vacation Package within the indicated time period may result in forfeiture.
Federal, state and local taxes, if any, are the sole responsibility of the Prize Winner, who will receive an IRS Form 1099 reflecting the final actual value of the Vacation Package, if valued at $600 or more. The Vacation Package may be subject to applicable withholding requirements. Prize Winner may receive and be required to sign other tax documents.
Promoter shall have the right, but not the obligation, to make any deductions and withholdings that Promoter deems necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances.

Vacation Package rules should include, but are not limited to:

• To visit the theme parks, valid admission is required for the same theme park on the same date for each person in the Group ages 3 and up.

• The Prize Winner is required to have and present at least one major credit card in good standing in order to check-in. Photo identification and credit card or cash deposit may be required at check-in for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the prize).

• Any damaged, lost or stolen Disney Gift Card will not be replaced. Disney Gift Card are not redeemable, refundable or exchangeable for cash (except as required by law) and are subject to the following terms: https://www.disneygiftcard.com/terms/us.

• By entering the Contest, Participant agrees to release and discharge WBLS, its parent, related, affiliated, and subsidiary companies and their respective officers, directors agents, employees and assigns, from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the prize, the receipt, use and/or enjoyment of the prize and/or the Contest.

• No transfer, assignment or substitution of a prize is permitted, except Sponsor reserves the right to substitute a prize for an item of equal or greater value in the event an advertised prize is unavailable. Any difference between the actual value and the approximate retail value of any prize will not be awarded. No substitution or cash equivalent will be made.

Sponsor is not responsible for cancellations or delays in travel accommodation and has no obligation to reimburse, refund or otherwise substitute any tickets awarded as a part of a travel prize due to such cancellations or delays. Travel guests of winner must be at least twenty-one (21) years of age or older. Winner and guest are responsible for all travel documents (such as government issued identification) required for travel. All other expenses and costs, not expressly listed above, including, but not limited to, federal, state, and local taxes, tips, meals, minibar, telephone calls, ground transportation (unless otherwise specified), and entertainment are the prize winner’s sole responsibility. Winner may be asked to provide a credit or debit card at time of check in. All travel risks, insurance, loss or damage due to prize acceptance or use is the sole responsibility of the prize winner. Sponsor will not be responsible for any loss, liability or damage arising out of the winner’s acceptance or use of the prize. Prize winner may wish to obtain travel insurance (or other forms of insurance) at their own expense and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance, unless specifically set forth herein.

Sponsor is also not responsible for any cancellation or rescheduling of the Grand Prize for any reason and has no obligation to reimburse, refund or otherwise substitute the vacation package for another prize.

• Tickets are nontransferable and are valid only during specific event dates and hours. Group members must guard Tickets against loss, theft or damage.

• To visit the theme parks, valid admission is required for the same theme park on the same date for each person in the Group ages 3 and up.

TAXES:

Winner is solely responsible for determining and paying all federal, state and local taxes (including any sales taxes). Any person winning over Six Hundred Dollars ($600) in prizes during any one-year period will receive an IRS Form 1099 at the end of the calendar year, and a copy of such form will be filed with the IRS.

ODDS OF WINNING:

The odds of winning the Contest prizes and the odds of winning the Grand Prize will depend on the number of eligible entries received.

WINNER SELECTION:

All eligible entries will qualify for the Grand Prize. One (1) Grand Prize winner will be randomly selected from all eligible winners on Monday, December 8, 2025 at approximately 11:00 am ET.

HOW TO CLAIM A PRIZE:

Claiming the Prize: Sponsor has the right in its sole discretion to mail the prize to the winner. The winner will initially be sent the required releases and prize claim forms. Winner is required to first sign the required forms and return them along with a picture ID electronically within seven (7) days. Alternatively, a winner may mail the required forms to WBLS at Attn: WBLS “Disney Cruise Destiny” Trip Giveaway Contest, 48 W. 25th Street, 3rd Floor, New York, NY 10010. Participants acknowledge that any postal service mailing of the release forms to Sponsor may significantly delay the mailing of a prize. After receipt of all signed required releases and claim forms, Sponsor will mail the prize to the winner. Failure by the winner to return completed forms within five (5) days of receipt of the forms may lead to forfeiture of the prize. Notwithstanding the foregoing, if Sponsor does not receive the completed forms within seven (7) days, then the prize will automatically be forfeited. Additionally, in the event the prize is mailed to the winner, the winner assumes the risk of the prize’s safe arrival. Sponsor may elect to change the method by which winner claims the prize. Should Sponsor change the method by which a winner claims the prize, Sponsor shall promptly inform winner of the new prize claim process.

Additionally, in the event the prize is mailed to the winner, the winner assumes the risk of the prize’s safe arrival. Prize winners must accept delivery of prize in the method as solely determined and designated by Sponsor. Prize shall be shipped to the designated winner residential address as provided at the time of entry and/or winner notification via USPS or other Sponsor designated shipping/mail carrier, or as otherwise designated by Sponsor. Allow up to approximately twelve (12) weeks for delivery. Once shipped, prize shall be considered awarded, delivered, and fulfilled, and Sponsor shall not be responsible for any prize shipment that is lost, late, delayed, undelivered, misdirected, misdelivered, damaged or stolen, or any incorrect shipping address provided by winner. In the event of any delivery issues, prize award shall not be replaced or substituted with any alternate prize award or compensation. Winner shall look solely to designated shipper/carrier and not to Sponsor for any delivery issues. Sponsor may elect to change the method by which winner claims the prize. Should Sponsor change the method by which a winner claims the prize, Sponsor shall promptly inform winner of the new prize claim process

Prerequisites to Prize Award: Prior to being awarded a prize, winners and their guests are required to provide: (1) a valid government-issued photo identification depicting proof of age and (2) a valid taxpayer identification number or social security number. The social security number will be used for tax-reporting purposes. Sponsor reserves the right to deny awarding the prize if the winner or guest fails to provide satisfactory identification, as determined in the Sponsor’s sole discretion.

Winner is required to execute an Affidavit of Eligibility, Release of Liability, Travel Waiver, Indemnification and Publicity Release Agreement and a completed IRS W-9 before any prize is awarded. By entering the Contest, Participant agrees to execute these documents if selected as a winner. Except where prohibited by law, failure to execute any of these documents or comply with any of these terms will result in forfeiture of the prize. Winner’s guest must be twenty-one (21) years of age and is required to execute an Affidavit of Eligibility, Release of Liability, Travel Waiver, Indemnification and Publicity Release Agreement prior to receiving the companion travel ticket.

Prize Forfeiture: Any winner who fails to redeem, claim, or utilize the prize will forfeit the prize. MediaCo reserves the right, in its sole discretion, to award unclaimed prizes to alternate contestants or not to award the unclaimed prizes.

Additional Costs: Any costs relating to the prizes are the sole responsibility of the winner.

WARRANTIES AND REPRESENTATIONS:

By entering and participating in the Contest, and in consideration thereof, each Participant individually warrants and represents to Sponsor that they: (i) meet the residency and age requirements at the time of entry; (ii) will be bound by these Rules and the General Rules, and by all applicable laws and regulations, and the decisions of the Sponsor; and (iii) waive any rights to claim ambiguity with respect to these Rules and the General Rules.

RELEASE OF LIABILITY AND INDEMNIFICATION:

As consideration for entering the Contest, all Participants agree to RELEASE, DISCHARGE AND COVENANT NOT TO SUE MediaCo WBLS License LLC, MediaCo Holding Inc., Live Nation, and the other Contest Entities (as described above) and each of their respective direct and indirect affiliates, divisions, parent and subsidiary companies, officers, employees, disc-jockeys, on-air personalities, shareholders, representatives, managers, members, directors, owners, agents, insurers, attorneys, predecessors, successors, and assigns thereof (collectively, the “Released Parties”), from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to their participation in the Contest, including, but not limited to, any claim that the act or omission complained of was caused in whole or in part by the strict liability or negligence in any form of the Released Parties.

Additionally, as consideration for entering the Contest, all Participants agree to INDEMNIFY, HOLD HARMLESS, AND DEFEND the Released Parties in any action or proceeding from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to their participation in the Contest or for their failure to comply with the terms of the above release provision. This agreement to indemnify, hold harmless and defend applies even if the act or omission complained of was allegedly caused in whole or in part by the strict liability or negligence in any form of the Released Parties.

This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, Instagram or any other social media platform. By submission of an entry, Participant releases Facebook, Twitter, Instagram, and all social media platforms from any responsibility or liability for the Contest’s administration, prizes or promotion. You are providing entry information to the Sponsors and not to Facebook, Twitter, Instagram or any social media platform.

PUBLICITY RELEASE:

Unless prohibited by applicable law, Participant authorizes and irrevocably grants to the Contest Entities (as defined above) permission, from time to time, to reference and discuss Participant and their participation in the Contest on-air and/or on their websites in photographs, video recordings, digital images, audio recordings, as well as in publications, newsletters, news releases, other printed materials, and in materials made available on the Internet or in other media now known or hereafter developed for any purpose the Contest Entities deem proper. Such reference and discussion may involve Participant’s name and voice, and other personal/biographical material or their participation on-air.

DISQUALIFICATION:

All Participants agree to be bound by these Rules. Non-compliance with any of these Rules will result in disqualification and all privileges of a Participant will be immediately terminated. Sponsor, in its sole discretion, further reserve the right to disqualify any person for: (i) tampering with the entry process or the operation of the Contest; (ii) gaining an unfair advantage in participating in the Contest; (iii) obtaining winner status using false, fraudulent or deceptive means; or (iv) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior.

CAUTION: ANY ATTEMPT BY ANY PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF ANY CONTEST, TELEPHONE SYSTEMS OR WEB SITE, OR UNDERMINE THE LEGITIMATE OPERATION OF ANY CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

RULES CHANGES AND INTERPRETATIONS:

Sponsor reserves the right in their sole discretion to supplement or make changes to these Rules as well as the rules of any contest at any time without notice. Sponsor reserves the right in its sole discretion to interpret the rules of any contest, and such interpretation shall be binding upon all participants.

AGREEMENT TO ARBITRATE:

To the fullest extent permitted by law, by participating in the Contest, a Participant understands and agrees that:

the Federal Arbitration Act applies to this agreement, and if the parties are unable to resolve their dispute amicably, it shall be resolved by means of binding arbitration (not in a court of law);

any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action (even if the rules and procedures of the arbitration tribunal allow class arbitrations);

any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event and under no circumstances will Participants be permitted to obtain awards for attorneys’ fees, and Participants hereby waive all rights to claim punitive, incidental, or consequential damages, or any other form of damages, other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased;

any claim or dispute regarding the Contest or these Official Rules will be resolved pursuant to the laws of New York, without regard to the conflicts of laws and rules of New York;

any claim or dispute regarding the Contest or these Official Rules will be resolved in a tribunal within the state of New York, and Participants submit to the jurisdiction of, and waive all objections to the jurisdiction or venue of, such tribunal; and

If for any reason a claim or dispute regarding the Contest or these Official Rules proceeds in court rather than through arbitration, there will not be a jury trial.

The invalidity or unenforceability of any provision of these Official Rules, including but not limited to the agreement to arbitrate, shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.
